What are the Nomadix Towel Scrub Club Contest Official Rules?
Dr. Squatch (“Sponsor” or “we” or “our”) is holding this contest (“Contest”) to allow you (“you” or “Participant”) to let the Doc know why these are your favorite Dr. Squatch products. By entering this Contest, you agree to be bound by these Official Rules. NO PURCHASE IS NECESSARY.
ELIGIBILITY. This Contest is open to legal residents of the United States who are at least 18 years of age as of the date of entry. Officers, directors, employees, and agents of Sponsor are not eligible to participate in the Contest. The Contest is subject to applicable federal, state, and local laws and regulations. VOID WHERE PROHIBITED.
SPONSOR. Dr. Squatch, LLC, 4065 Glencoe Ave, STE 300B, Marina Del Rey, CA 90292.
ENTRY PERIOD: The Contest entry period begins February 7th, 2024, at 10:30 Am PST and ends February 19th, 2024, at 3:00 pm PST (“Entry Period”). Sponsor’s computer clock is the official timekeeping device of the Contest.
HOW TO ENTER. All entries must be submitted during the Entry Period in the manner described in these Official Rules. Comment on the announcement post of the giveaway in Scrub Club Facebook or Discord with which Dr. Squatch product you would use before drying off with the Nomadix Towel? The comment must end with #scrubclub. (“Entry”). The entry must not: (1) have ever been previously published; (2) infringe upon any rights of any third party, including without limitation copyright, trademark, and rights of publicity or privacy; (3) be, or contain any content that is or may be perceived as, immoral, defamatory, derogatory, offensive, illegal, sexually suggestive, obscene, violent, or similarly inappropriate, or that represents Sponsor in a negative way or in any manner not consistent with Sponsor’s brand and/or reputation; (4) contain, include, or encourage images or activities that are dangerous, unsafe, or present unreasonable risk of harm to person or property; (5) contain any mention, discussion, logo, trademark, service mark, storefront, trade dress, mascot, photograph, or other image or intellectual property of any business or company without that entity’s prior written consent; and (6) contain any names or private and/or sensitive information about the Participant or anyone else. Such inappropriate Entries are strictly prohibited, and any Entry in violation of the above requirements and restrictions, as determined in Sponsor’s sole and absolute discretion, shall be deemed void. Contest is limited to one Entry (i.e., submission) per person. The top two entries, as determined by Sponsor in its sole discretion, will be chosen as winners from the eligible entries (“Winners”), ranked by 1st Place and 2nd Place
PRIZES. The prizes that can be won are listed below by contest.
Contest #1: Nomadix Towel Contest. There will be a total of five (5) prizes awarded. Five 1st Place Prizes: one (1) Dr. Squatch themed Nomadix Towel (Verifiable Retail Value Of One Prize: $39.95 ).
Any taxes on Prizes won will be the sole responsibility of the winners. No substitution or transfer of Prizes permitted, and Prizes cannot be redeemed for cash. No Prize substitutions are allowed except by Sponsor, who may award a prize of equal or greater value.
HOW TO CLAIM A PRIZE. Sponsor will notify the Winners by scrub club post and facebook or discord DM to the account associated with their submission that they have been chosen as Winners in the Contest. Neither Sponsor nor its affiliates, or any of the foregoing parties’ officers, directors, employees, or agents shall have liability for a Winner’s failure to receive an email notice of the results, regardless of the reason, including without limitation failures due to spam, junk e-mail, or other security settings or due to the Winner providing incorrect or otherwise inaccurate contact information. In the event of any of the following, the Prize for a Winner may be forfeited: (i) the Winner’s Entry is discovered to be invalid for any reason whatsoever; (ii) the Winner either fails to comply with these Official Rules prior to delivery of the Prize or refuses the Prize; or (iii) the Winner cannot be contacted for any reason (including an email delivery failure), fails to claim their Prize within five (5) days from the date that notification was sent, or fails to timely return a completed and notarized affidavit of eligibility and release as required by Sponsor and noted below.
The receipt of the Prize by a Winner is conditioned upon compliance with any and all federal and state laws and regulations. ANY VIOLATION OF ANY OF THESE OFFICIAL RULES BY A WINNER (AS DETERMINED BY SPONSOR IN ITS SOLE DISCRETION) WILL RESULT IN SUCH WINNER’S DISQUALIFICATION AND ALL PRIVILEGES, INCLUDING THE AWARD OF THE PRIZE, WILL BE IMMEDIATELY TERMINATED.
APPLICATION OF RULES. By entering the Contest, you warrant that you have read and agree to abide and be bound by these Official Rules, and you warrant that you are not prohibited from participating in the Contest. You agree that Sponsor retains full authority, in its sole discretion, to interpret and administer these Official Rules and further agree to be bound by all decisions and interpretations made in good faith by Sponsor. Sponsor shall have the absolute right to determine, without notice to the person attempting to enter, if an Entry is in compliance with these Official Rules. If there is a dispute over the identity of a Participant, such Entry will be deemed submitted by the individual whose email address associated with the account associated with the Entry. Each Participant grants to Sponsor a perpetual, nonexclusive, worldwide right and license to use the Entry and the image shown in the Entry in all media now known or later developed, including without limitation the right to duplicate, copy, repost, distribute, display, and make derivative works thereof.
IRREGULARITIES; FORCE MAJEURE. Sponsor, in its sole discretion, reserves the right to cancel, terminate, modify, or suspend the Contest if, for any reason, the Contest is not capable of running as planned due to any of the following that affects the administration, security, fairness, or integrity of the Contest: (i) technical failures, tampering, unauthorized intervention, or fraud, or (ii) any other causes beyond Sponsor’s control, including but not limited to fire, flood, natural or man-made epidemic of health, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared) or any federal state or local government law, order, or regulation, public health crisis, order of any court or jurisdiction (any of which is an “Irregularity”). In the case of an Irregularity, Sponsor may select the Winners from all eligible Entries prior to the Irregularity (if appropriate). Sponsor reserves the right in its sole discretion to disqualify any Participant who tampers or attempts to tamper with the entry process or the operation of the Contest or any Participant who violates these Official Rules. Any attempt by any Participant to deliberately damage any website or undermine the legitimate operation of the Contest may be a violation of criminal and civil laws. Should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law.
RELEASE; LIMITATIONS ON LIABILITY: By participating in this Contest, you release and hold harmless Sponsor and its affiliates, and the foregoing parties’ directors, officers, employees, and agents of each (all collectively, “Releasees”) from any and all liability for claims, injuries, losses, damage, or harm of any kind (“Harm”) arising from or in connection with the Contest or the Prizes, including but not limited causes of action or claims related to or arising out of (i) a Participant’s participation in this Contest, (ii) acceptance of the Prize, (iii) the Prize, including without limitation use thereof, and/or (iv) a Participant’s use of any Dr. Squatch product.
Releasees are not responsible for and have no liability for Harm caused by any of the following: (i) incorrect or inaccurate Entry information, whether caused by any of the equipment or software associated with or utilized in the Contest, or by any technical or human error; (ii) a Participant’s difficulty in submitting their Entry ; (iii) technical or mechanical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (iv) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (v) unauthorized human intervention in any part of the Entry process; (vi) electronic or human error which may occur in the administration of the Contest; (vii) any error, statement, or announcement that may give an erroneous indicator the Prize has been won; (viii) any notice to a Winner that is returned undeliverable to Sponsor; (ix) the failure of Winner to timely claim the Prize; and (x) any Irregularity. By participating in this Contest, you waive any right to claim ambiguity in these Official Rules. Should the Contest be terminated prior to the end of the Entry Period, notice will be posted at https://www.facebook.com/groups/drsquatchscrubclub and http://discord.gg/drsquatch in the Scrub Club Announcements channel.
DISCLAIMER OF WARRANTIES: SPONSOR MAKES NO REPRESENTATIONS OR WARRANTIES, EXPRESS OR IMPLIED, ORAL OR WRITTEN, CONCERNING THIS CONTEST OR THE PRIZES. SPONSOR EXPRESSLY DISCLAIMS ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGFEMENT. ANY IMPLIED WARRANTIES THAT MAY BE IMPOSED BY APPLICABLE LAW ARE LIMITED IN ALL RESPECTS TO THE DURATION OF THE CONTEST. IN NO EVENT WILL THE RELEASEES BE LIABLE FOR ANY DAMAGES WHATSOEVER, INCLUDING WITHOUT LIMITATION, DIRECT OR INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. The above disclaimers do not apply in states where prohibited.
PRIVACY NOTICE. By entering the Contest, each Participant may receive marketing materials, communications, and other materials from Sponsor and other companies whose products and services Sponsor believes might interest Participants at a future date.
GOVERNING LAW. California law governs the operation of this Contest, these Official Rules, and the disclaimers made herein, regardless of another state’s choice of law principles. By entering this Contest, you agree to exclusive personal jurisdiction in the appropriate state or federal court residing in Los Angeles County, California. All federal, state, and local laws and regulations apply.
