NO PURCHASE NECESSARY TO WIN. OPEN ONLY TO LEGAL RESIDENTS OF THE UNITED STATES WHO ARE OF LEGAL AGE OF MAJORITY IN THEIR STATE OF RESIDENCE (WHICH IS 18 IN MOST STATES, 19 IN ALABAMA AND NEBRASKA, AND 21 IN MISSISSIPPI). VOID IN RHODE ISLAND AND WHERE PROHIBITED.
ELIGIBILITY. OPEN ONLY TO LEGAL RESIDENTS OF THE UNITED STATES WHO ARE 18 YEARS OF AGE OR OLDER. VOID IN RHODE ISLAND AND WHERE PROHIBITED. The Dr. Squatch Batman & Joker Comic Book Sweepstakes (the “Sweepstakes”) is only open to legal residents of the United States who are at least 18 years of age as of the date of entry. Owners, officers, directors, and employees of Sponsor are not eligible to participate in the Sweepstakes. The Sweepstakes is subject to all applicable federal, state, and local laws and regulations.
SPONSOR: Dr. Squatch, LLC, 4065 Glencoe Ave, STE 300B, Marina Del Rey, CA 90292. Warner Bros. (“Warner Bros.”) is not associated with the administration, conduct or prize fulfillment of the Sweepstakes.
HOW TO ENTER: This Sweepstakes begins at 3:00pm PST on 10/15/2024 and ends at 11:59pm PST on 11/15/2024 ("Entry Period"). You (“you” or “entrant”) can enter this Sweepstakes in one of two ways. On Instagram: To enter the Sweepstakes via Instagram, (1) go to https://www.instagram.com/drsquatch/, (2) like our Sweepstakes post, (3) follow us at @drsquatch, and (iv) leave a comment on this post. One comment: one entry. Alternate method of entry: enter this Sweepstakes by completing the entry form at https://forms.gle/aMjdpxJ3vG7Vsrsh7. An eligible entrant may use either entry method. Multiple entries submitted by an entrant are allowed. NO PURCHASE IS NECESSARY TO ENTER THIS SWEEPSTAKES, and purchases at our website will not increase your chances of winning.
CONDITIONS OF ENTRY: Eligible entrants must enter through Dr. Squatch’s Instagram site or through its online website entry as described above. Incomplete entries are void. By entering, entrants acknowledge compliance with these Official Rules, including all eligibility requirements, and agree to be bound by the terms and conditions of the entrant’s Instagram account. Use of any automated system to participate is prohibited and will result in disqualification. Neither Sponsor nor any of its affiliates or their respective directors, officers, employees, agents, or any telephone network or Internet service providers are responsible for incorrect or inaccurate transcription of entry information, or for any human error, technical malfunctions, lost/delayed data transmission, omission, interruption, deletion, defect, line failures of any telephone network, failures in connectivity, computer equipment, software, inability to access Sponsor’s website or any online service, failure to access the Instagram app or website, or any other error or malfunction, or late, lost, illegible, incorrect, or misdirected entries. Entries that have been tampered with or altered are void. No entries with fake usernames or false accounts will be accepted. In the event of a dispute as to any registration, the authorized account holder of the Instagram account who enters the Sweepstakes through Instagram or the email account listed in the online registration, as applicable, will be deemed to be the entrant. The “authorized account holder” is either (i) the natural person associated with the username for the Instagram account and the assigned telephone number by the wireless carrier identified for this account, or (ii) the natural person associated with the email address provided with the online website entry. A potential winner will be required to show proof of being the authorized account holder. Sponsor reserves the right to contact entrants and all other individuals whose Instagram information, phone number and/or email address is submitted as part of this promotion. All entries become the property of the Sponsor.
SOCIAL MEDIA: Should an entrant post or repost a link to this Sweepstakes on Instagram or any other social media site, such entrant agrees to follow and to be bound by all rules and regulations required of that social media site, including without limitation rules governing Sweepstakes and promotions. Failure of any entrant to abide by these Official Rules, the rules of Instagram, or the rules of any social media platform with respect to this Sweepstakes shall result in the disqualification of entrant. By participating, you acknowledge this is a sweepstakes entry and not an endorsement of our brand
PRIZES: 2 winners will each receive (1) set of Batman and Joker comic books, which is defined as: Set 1: Batman #608 - CGC 9.8 and Batman #50 - CGC 9.2/Signed by Brian Bolland OR Set 2: Batman #423 CGC 9.0 and Batman #251 - CGC 7.5. The prize will be awarded as 2 physical comic books. (“Prize”). Total prize is valued at $2572.94. The winners will receive 1 of the 2 sets at random. Any taxes on Prizes won will be the sole responsibility of the winners. No substitution or transfer of Prizes are permitted, and Prizes cannot be redeemed for cash. No Prize substitutions are allowed except by Sponsor, who may award a prize of equal or greater value.
SELECTION OF WINNERS; NOTIFICATION: 2 Prize winners shall be randomly selected on 11/15/2024 from the total eligible entries. Odds of winning depend on the total number of entries. Winners will be notified beginning on 11/18/2024 but no later than 11/29/2024 by direct message through the individual’s Instagram account, or for online entries, via the provided email address. Neither Sponsor nor its affiliates or any of their respective officers, directors, employees, or agents shall have liability for a winner’s failure to receive a direct message or email notice of winning, regardless of the reason, including without limitation failures due to spam, junk e-mail, or other security settings or due to winner providing incorrect or otherwise inaccurate contact information. In the event of any of the following, the Prize may be forfeited and an alternate winner may be selected at random from the remaining eligible Entries until that Prize has been awarded: (i) a winning Entry is discovered to be invalid for any reason whatsoever; (ii) a selected potential winner either fails to comply with these Official Rules prior to delivery of the Prize or refuses the Prize or any portion thereof; or (iii) a selected potential winner cannot be contacted for any reason (including an email delivery failure), fails to claim the Prize within seven (7) days from the date that notification was sent, or fails to timely return a completed affidavit of eligibility and release as required by Sponsor.
Upon contacting a potential winner and determining that all eligibility requirements for the Sweepstakes have been met, including without limitation the execution of an affidavit of eligibility and release (except where prohibited by law) and completion of such other documents as Sponsor may reasonably require, if applicable, such individual will be declared an “official winner” of the Sweepstakes.
The receipt by each winner of a Prize is conditioned upon compliance with any and all federal and state laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY ANY WINNER (AS DETERMINED BY SPONSOR IN ITS SOLE DISCRETION) WILL RESULT IN SUCH WINNER’S DISQUALIFICATION AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED. All decisions relating to this Sweepstakes are final.
WINNERS: By entering this Sweepstakes, the winners consent to the use of their names, identities, and/or photographs for promotional purposes, including online announcements and social media posts, without additional compensation and without prior consent of the winner, except where prohibited by law.
IRREGULARITIES. If, for any reason, the Sweepstakes is not capable of running as planned due to technical failures, tampering, unauthorized intervention, fraud, or any other causes beyond Sponsor’s control (each, an “Irregularity”) that affects the administration, security, fairness, or integrity of this Sweepstakes, Sponsor, in its sole discretion, reserves the right to cancel, terminate, modify, or suspend the Sweepstakes. In the case of an Irregularity, Sponsor may select the winners from all eligible Entries prior to the Irregularity (if appropriate). Sponsor reserves the right in its sole discretion to disqualify any entrant who tampers or attempts to tamper with the entry process or the operation of the Sweepstakes or any entrant who violates these Official Rules. Any attempt by any entrant to deliberately damage any website or undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil laws. Should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law.
Releasees (as defined below) are not responsible for and have no liability for Harm (as defined below) caused by any of the following: (i) incorrect or inaccurate Entry information, whether caused by any of the equipment or software associated with or utilized in the Giveaway, or by any technical or human error; (ii) difficulty in utilizing Instagram and/or leaving a comment at https://www.instagram.com/drsquatch/; (iii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (iv) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (v) unauthorized human intervention in any part of the Entry process; (vi) electronic or human error which may occur in the administration of the Sweepstakes; (vii) any error, statement, or announcement that may give an erroneous indicator the Prizes have been won; (viii) notice to a selected potential winner that is returned undeliverable to Sponsor; and (ix) any Irregularity. By participating in this Sweepstakes, you waive any right to claim ambiguity in these Official Rules.
RELEASE; LIMITATIONS ON LIABILITY: By participating in this Sweepstakes, you release and hold harmless the Sponsor, Warner Bros., and their respective affiliates and each of their respective directors, officers, employees, and agents (collectively, “Releasees”) from any and all liability for claims, injuries, losses, damage, or harm of any kind (“Harm”) arising from or in connection with the Sweepstakes or the Prize, including but not limited to any personal injury, death, loss, or damage of any kind or any other causes of action or claims (i) related to a entrant’s participation in this Sweepstakes or acceptance or use of the Prize and/or (ii) based on an entrant’s use of any Dr. Squatch product.
DISCLAIMER OF WARRANTIES: SPONSOR MAKES NO REPRESENTATIONS OR WARRANTIES, EXPRESS OR IMPLIED, ORAL OR WRITTEN, CONCERNING THIS SWEEPSTAKES OR PRIZES. SPONSOR EXPRESSLY DISCLAIMS ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON INFRINGEMENT. ANY IMPLIED WARRANTIES THAT MAY BE IMPOSED BY APPLICABLE LAW ARE LIMITED IN ALL RESPECTS TO THE DURATION OF THE SWEEPSTAKES. PRIVACY NOTICE. If an entrant enters through Sponsor’s website, such entrant may receive marketing materials, communications, and other materials from Sponsor and other companies whose products and services Sponsor believes might interest entrants at a future date.
GOVERNING LAW. California law governs the operation of this Sweepstakes, these Official Rules, and the disclaimers made herein, regardless of another state’s choice of law principles. By entering this Sweepstakes, you agree to exclusive personal jurisdiction in the appropriate state or federal court residing in California. All federal, state, and local laws and regulations apply.
FORCE MAJEURE. The failure of Sponsor to comply with any provision of these Official Rules due to an act of God, hurricane, war, terrorism, strike, fire, riot, earthquake, epidemic/pandemic, including without limitation COVID-19, actions of governmental authorities outside the control of Sponsor, or other force majeure event shall not be considered a breach of these Official Rules.
